Webinar: 2019 Legal and Risk Management Issues in the ED

WHO SHOULD PARTICIPATE: Emergency department staff including physicians, nurse managers and ED and clinic nurses, in-house legal counsel, risk managers, compliance officers, nurse educators, patient safety officers, TJC coordinators, and anyone involved with the care, treatment and liability concerns of an ED patient.

OVERVIEWThis webinar will focus on legal and risk management issues faced by healthcare providers who care for patients in the emergency department (ED) environment.

The speaker will discuss how to comply with the Centers for Medicare and Medicaid Services’ (CMS) hospital conditions of participation (CoPs) and the Joint Commission (TJC) standards that are problematic for emergency department staff.

The presenter will discuss TJC standards on patient-centered communication, including the interpreter, low health literacy, and collecting race and ethnicity data in the ED.  In addition, the speaker will discuss OCR Section 1557 requirements. For example, there must be a sign in the ED, revised patient rights statement, qualified interpreters, auxiliary aids, and more.  Do you know what the new law says if an ED patient writes a complaint letter about being discriminated? The webinar will provide additional resources on TJC proposed pain management standards.

This webinar will also cover the CMS CoP changes that require all ED nurses to have training on blood transfusion and IV medication and what must be included. Also, the presenter will review CMS five requirements for discharge instructions.

OBJECTIVES:

At the conclusion of this session, participants will be able to:

  • Discuss legal and risk management issues in the ED;
  • Explain the CMS and TJC standards to collect race and ethnicity data in the ED;
  • Describe the importance of documenting the use of interpreters for patients with limited English proficiency; and
  • Discuss how the visitation law requires the ED to give the patient written information on their rights.

MEET YOUR FACULTY: Sue Dill Calloway, President, Patient Safety and Health Care Education and Consulting

Sue has been a nurse attorney and consultant for more than 30 years. Currently, she is president of Patient Safety and Healthcare Education and Consulting and previously was the chief learning officer for the Emergency Medicine Patient Safety Foundation. She has conducted many educational programs for nurses, physicians and other healthcare providers. She has authored more than 100 books and numerous articles. She is a frequent speaker and is well known across the country in the area of healthcare law, risk management and patient safety.

Webinar materials are provided 1-2 business days in advance of the webinar. Once webinar materials are distributed no refunds will be issued and full payment is expected.

CANCELLATION POLICY:

Cancellations received in writing up to one week prior to a scheduled event will be charged a cancellation fee of $40 (per person, per event). Registrants who are unable to attend an LHA educational event are permitted to, and encouraged to send a substitute without incurring a cancellation fee. Please send written notice of any substitutions prior to the scheduled event. Cancellations received less than one week prior to the scheduled event, or individuals who fail to attend will result in a non-refundable registration fee.


TRANSFER POLICY:
Transfer requests must be in writing and received one week prior to the event to receive a credit to use at a later date. A $40 transfer fee will be charged.  The LHA will hold your credit for a period of one year following the start date of the program for which you were originally registered. Transfer requests received less than one week prior to event will result in a non-refundable registration fee.

The substitution option is not available if written notification is received by the LHA less than seven business days before the scheduled program.
